SMS Terms of Service

These SMS Terms of Service ("SMS Terms") govern the use of Short Message Service (SMS) and Multimedia Messaging Service (MMS) communications sent through or on behalf of Skode Technologies Private Limited ("Skode," "we," "us," or "our"), a private limited company incorporated in India with registered office at Thirumangalath, Chelavur, Kozhikode – 673571, Kerala, India. By opting in to receive SMS messages from Skode or from businesses using the Skode platform, you agree to these SMS Terms.
Who sends the SMS. Skode does not independently send SMS to consumers. When you receive an SMS from a business using the Skode platform, that business — not Skode — is the sender under applicable telecommunications and data-protection law. The sending business is responsible for obtaining your consent, honouring your opt-out, and complying with the laws of its jurisdiction and yours. Message and data rates may apply.
These SMS Terms are incorporated into our Terms of Service, Privacy Policy, and SMS Compliance Policy. Please read them carefully.
1. Consent
By providing your mobile phone number and opting in, you expressly consent to receive SMS and MMS messages from Skode or businesses using the Skode platform. Consent is not a condition of purchasing any goods or services from Skode or our customers.
You may opt in to receive SMS messages by:
- Entering your phone number in a web form and checking the SMS consent box.
- Texting a keyword (e.g., "JOIN" or "START") to a designated short code or phone number.
- Providing verbal consent during a phone call (recorded and documented).
- Signing a written consent form (physical or electronic).
By opting in, you confirm that you are the owner or authorized user of the mobile device associated with the phone number provided and that you are authorized to approve the applicable charges.
2. Types of Messages
Depending on your consent, you may receive the following types of SMS messages:
- Transactional Messages: Order confirmations, appointment reminders, shipping notifications, account alerts, verification codes, and other service-related messages.
- Promotional Messages: Marketing offers, discounts, product announcements, event invitations, and other promotional content.
- Conversational Messages: Two-way conversations initiated by you through Skode-powered messaging channels.
3. Message Frequency
Message frequency varies depending on the type of messages you have opted in to receive and the business sending the messages:
- Transactional Messages: Sent as needed based on your interactions and account activity. Frequency depends on your usage of the service.
- Promotional Messages: Typically no more than 4 messages per month, unless you have opted in to a higher frequency. The sending business will disclose the expected frequency at the time of opt-in.
- Conversational Messages: Frequency depends on the conversation. You control the pace of two-way conversations.
4. Opt-Out Instructions
You can opt out of receiving SMS messages at any time. To stop receiving messages:
- Reply STOP: Text STOP to any message you receive from us. You will receive a one-time confirmation message acknowledging your opt-out request. No further messages will be sent.
- Reply CANCEL, UNSUBSCRIBE, END, or QUIT: Any of these keywords will also unsubscribe you from SMS messages.
- Contact Support: Email support@skode.ai with your phone number and a request to be removed from SMS communications.
- In-App: Manage your SMS preferences in your account settings within the Skode platform.
After opting out, you may still receive transactional messages related to your account (such as security alerts or verification codes) that are necessary for the operation of the service. You can opt out of these by closing your account.
5. Help Instructions
If you need assistance with SMS messages from Skode or a business using the Skode platform:
- Reply HELP: Text HELP to any message you receive. You will receive a message with contact information and instructions.
- Email: Contact us at support@skode.ai.
6. Message and Data Rates
Standard message and data rates may apply to SMS and MMS messages sent to or from your mobile device, as determined by your wireless carrier. Skode is not responsible for any charges incurred by you from your wireless carrier as a result of receiving or sending SMS messages.
Check with your wireless carrier for details on your messaging plan, including any applicable fees for SMS and MMS messages.

Additional carriers in other countries are supported through our international messaging partners. Carrier availability and coverage may vary by region. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless carrier.
8. Privacy
Your phone number and SMS-related data are handled in accordance with our Privacy Policy. Specifically:
- We collect your phone number and consent records to send you SMS messages and comply with regulatory requirements.
- We do not sell, rent, or share your phone number with third parties for their marketing purposes.
- Your phone number is shared only with our SMS service providers (sub-processors) as necessary to deliver messages. These providers are bound by data processing agreements.
- We retain your phone number and consent records for as long as you are subscribed to SMS messages, plus a reasonable period thereafter for compliance purposes.
- You may request deletion of your phone number and SMS data by contacting privacy@skode.ai. See our Data Deletion Policy for details.
9. Obligations for Businesses Using Skode
If you are a business using the Skode platform to send SMS messages to your customers, you are responsible for:
You are the sender under applicable telecommunications law; Skode provides the tools. Your obligations include:
- Obtaining consent. For marketing SMS in the US you must obtain prior express written consent as required by the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227) and the FCC’s implementing rules. For GDPR/UK GDPR recipients, prior opt-in consent is required. For Canadian recipients, CASL express consent applies. For Australian recipients, the Spam Act 2003 applies.
- Disclosure at opt-in. You must clearly disclose (a) that the user is consenting to receive SMS messages, (b) from whom, (c) the types of messages, (d) the expected frequency, (e) that “Message & data rates may apply”, and (f) how to opt out (reply STOP). Pre-ticked boxes are not valid consent.
- Proof of consent. Maintain timestamped records of consent for each recipient including the phone number, method of consent (web form, keyword opt-in, written, verbal), the exact consent text shown, and the source (URL, call ID, etc.). Retain records for a minimum of five years or the period required by applicable law, whichever is longer.
- Honouring opt-outs. You must promptly honour all opt-out requests, including responses to the standard keywords STOP, UNSUBSCRIBE, CANCEL, END, and QUIT. After a user opts out, do not send any further messages including “sorry to see you go” replies. The keyword HELP must always return a response pointing recipients to customer support, even after opt-in.
- Do-Not-Contact lists. Maintain a suppression list of all opted-out recipients and check it before every campaign. Respect government do-not-call / do-not-disturb registries that apply to your campaign (US National Do Not Call Registry, Canada National DNCL, India TRAI DND / NCPR, UK TPS/CTPS, etc.).
- US 10DLC registration. If you send Application-to-Person SMS to US mobile numbers, you must register your brand and each campaign with The Campaign Registry (TCR) for 10DLC. Unregistered traffic is throttled or blocked by US carriers. Short-code traffic additionally requires CSCA / CTIA approval.
- India TRAI DLT registration. If you send commercial SMS to Indian numbers, you must register your entity, sender header, and each message template on the TRAI Distributed Ledger Technology (DLT) platform. Unregistered or non-template SMS is blocked by Indian telecoms.
- Content compliance. All SMS content must comply with our Acceptable Use Policy and Anti-Spam Policy.
- Quiet hours. Do not send marketing SMS before 8:00 AM or after 9:00 PM in the recipient’s local time zone.
10. Regulatory Compliance
All SMS communications sent through the Skode platform must comply with applicable laws and regulations, including:
- TCPA (USA): The Telephone Consumer Protection Act (47 U.S.C. § 227) requires prior express written consent for marketing SMS and provides recipients with the right to opt out. Violations can result in penalties of $500 to $1,500 per message.
- 10DLC Registration (USA): Application-to-Person SMS to US mobile numbers requires brand and campaign registration with The Campaign Registry. Unregistered traffic is subject to carrier filtering.
- CTIA Short Code Monitoring Handbook: Industry operational rules for 5–6 digit short-code SMS campaigns, including pre-launch review and ongoing monitoring.
- CAN-SPAM Act (USA): Applicable to commercial SMS messages containing email-to-SMS content.
- CASL (Canada): Canada’s Anti-Spam Legislation requires express prior consent for marketing SMS, sender identification, and a working unsubscribe. Penalties up to CAD 1.5 million for organisations.
- Australian Spam Act 2003: Requires express or inferred consent for commercial SMS, accurate sender identification, and a functional unsubscribe mechanism. Penalties up to AUD 555,000.
- TRAI DLT Platform (India): Commercial SMS to Indian numbers requires Principal Entity registration, header registration, and template approval on a TRAI-approved DLT platform. See SMS Compliance Policy.
- TRAI Commercial Communications Customer Preference Regulations 2018 (India): You must honour the National Do Not Disturb / Customer Preference Register.
- DPDPA 2023 and IT Act 2000 (India): Personal-data processing and commercial electronic communications.
- PECR (United Kingdom): The Privacy and Electronic Communications Regulations 2003 (as amended) require prior consent for direct marketing by electronic means, including SMS. Marketing SMS to UK recipients requires opt-in consent. Soft opt-in may apply where there is an existing customer relationship and the marketing relates to similar products or services. Violations may result in enforcement action by the Information Commissioner's Office (ICO), including fines of up to £500,000 under PECR and up to £17.5 million or 4% of global turnover under UK GDPR where applicable.
- Ofcom Regulations (UK): Compliance with Ofcom rules on premium-rate services, short codes, and unsolicited communications. Ofcom has the authority to investigate complaints related to SMS nuisance calls and messages.
- GDPR (EU/EEA) and UK GDPR: Requires lawful basis for processing phone numbers and sending SMS, including the right to withdraw consent. The ePrivacy Directive (2002/58/EC) as implemented in each member state governs electronic marketing communications.
- TRAI Regulations (India): Compliance with Telecom Regulatory Authority of India regulations, including DND (Do Not Disturb) registry requirements.
11. Limitation of Liability
Skode and its affiliates, officers, directors, employees, and agents shall not be liable for any delays, failures in delivery, or errors in the content of SMS messages, to the extent permitted by applicable law. SMS messaging is dependent on wireless carrier networks and third-party infrastructure over which Skode has no control.
12. Changes to These SMS Terms
We may update these SMS Terms from time to time. Changes will be posted on this page with an updated effective date. Continued receipt of SMS messages after changes are posted constitutes acceptance of the updated terms. If we make material changes, we will notify you via SMS or email.
